The age of sexual consent is 18 for both girls and boys. However, the law allows girls, from the age of 10 to engage in sexual relations if they are married. In order to be married, the judge must provide his persmission and it must be proven that marriage is in the best interest of the girl, that her husband is suitable and able to pay the dowry. The national legislation does not provide for a close-in-age exemption.

Active extraterritoriality is recognised for all offences under the Sudanese Criminal Act and the Sudanese Penal Code sections 7 and 4(2) respectively. Double criminality is only required under section 7 of the Criminal Act for active extraterritoriality.
