ECPAT Austria was founded in November 2003 as a specialized body working against any form of sexual exploitation of children. The coalition is a nationwide platform of non-governmental organizations as well as individual members, that are active in the areas of children’s rights or in development cooperation. Since December 2006 ECPAT Austria is a non-profit association and carries out campaigns and projects in cooperation with governmental and non-governmental organizations as well as network partners to raise public awareness, develop preventive measures, and create legal bases for the protection of children.

Austria has a solid legal framework, as far as Civil and Penal Law is concerned, aiming at protecting children from violence and abuse. Key provisions of the Child Rights Convention related to protection from all forms of violence are even entrenched in Austria’s Constitution. Initiated by and in cooperation with ECPAT Austria, numerous measures for awareness raising and educational purposes have been implemented, especially on topics of Safeguarding, child trafficking, and sexual exploitation of children in travel and tourism. The number of training for police officers have increased as well as the distribution of information material such as ‘Child trafficking in Austria. Background Information and Checklist to Assist Youth Welfare Authorities, Police Forces, Aliens’. Austria is a destination and transit country for children trafficked for sexual purposes and criminal activities. Most of the victims are Eastern or SoutheasternEuropean.
However, ECPAT Austria together with other child rights activists in Austria and various monitoring bodies (UN-CRC, Council of Europe-GRETA, European Commission) are pointing out deficits and gaps in law enforcement and are constantly providing the necessary resources to service providers of child protection.

Active and passive extraterritoriality is provided for all SEC-related offences covered by the legislation of Austria under Section 64.1(4a) of the Criminal Code. Double criminality is not required.
SEC-related offences can be extraditable if they are punished with at least one year of imprisonment under Austrian law (including child trafficking, serious sexual abuse of minors and potentially other SEC offences) and fulfil the double criminality requirement under Section 11 of the Federal Law on Extradition.
SEC offences are referred to as extraditable under the European Arrest Warrant (EAW) framework without requiring double criminality within the EU if the act is punishable by a maximum period of at least three years of imprisonment in the requesting State.
